Employee HarassmentHarassment is defined as irritating or frustrating somebody without any cause or basis. It can be of various types and in variety of forms. Each and every individual is equal in eyes of law and has equal freedom to live and work. So, it becomes an obvious fact that harassment of any sort is illegal and unjust. Apart from social harassment, discrimination in the work place has also become widespread these days. An employee because of certain factors are harassed and discriminated by the employer or boss of the organization. Such harassment causes financial and emotional impact on the employee which demoralizes him or her. The court of law condemns harassment and discrimination of any sort. It is illegal and unlawful when an employee is made to suffer at the hands of the employer. The harassment of any sort or form will be considered illegal, including verbal abuse, physical, mental torture, gender, insult and aversion towards an employee in the workplace. Some of the common discriminations reported at work place can be due to the employees' race, religion, sex, creed, age, major or minor disability and pregnancy. Any sorts of behavior or action on part of employer that can make the employee feel humiliated and offended, is unlawful. There were times when a place was surrounded with a particular kind of natives only. But with advancement in science and technology, people have begun to relocate and migrate in search of good job openings in various places and countries. This has led to the increase of mix-culture at work place. Employees from different cultural backgrounds work together at a place and contribute in the healthy growth of the business organizations. But this has given rise to a negative effect also. Some companies are not able to accept this mix-culture atmosphere in their organizations. In addition, there are some companies where the employees are sexually assaulted. The employee is not able to utter a word because it can let him or her being fired out of the organization. Therefore, to save the respect and self-esteem of employees, employment laws have been made that are strict towards employers that follow such discrimination in the workplace. The laws have laid down the terms and condition for the employers instructing them how to behave with employers and job applicants. The major issue of our society is that people are not aware about the legal rights that safeguard them against surrendering before such discriminations. Therefore, every employee should remain aware of such laws which can prove to be essential to them at any point of time. The time to remain quiet and fear the biased employer is gone a long time back. If an employee feels that he or she has been harassed or discriminated because of a bias, then the employee can file his or her complaint to EEOC (Equal Employment Opportunity Commission). The commission investigates in the matter and warns the accused to stop this unlawful practice immediately. If the employer continues to behave similarly even after the warning, the victim has full rights to file a case against the employer. |
